Consider, however, the following case: Suppose that, as part of a puerile reality show, the defendant sprays a stinky gas that could potentially prove lethally injurious at two people, A and B. It is clear that A does not consent, but the defendant simply does not care; by contrast, the defendant has strong reason to believe (in part on the basis of a reasonable interpretation of her gestures) that B does consent. Suppose it turns out that B does not in fact consent (and, for good measure, suppose that the prospect that her gestures might be interpreted as consent, or that she might otherwise be taken to consent, was not reasonably foreseeable to B). If both A and B are killed by the gas, it seems clear that the defendant is liable to compensate both of their estates. But the apparent consent privilege, if taken at face value, denies B’s estate such recovery.175
